Product Information

All prices displayed on the Van Der Zon Web sites are quoted in U.S. dollars and are valid in the United States. We charge sales tax as applicable. We reserve the right without prior notice to discontinue or change specifications and prices on products and services offered on the Company's Web sites. All products displayed on the Van Der Zon Company's Web sites are available while supplies last. Please confirm availability prior to purchasing any product. We reserve the right to cancel a sale and issue a return authorization for merchandise that is unexpectedly out of stock or does not conform to specifications by the manufacturer. We reserve the right to limit the order quantity on any items without prior notice.

Product Descriptions

The Company attempts to be as accurate as possible in the product representations and/or service offered, and Web site content. Electronic images from computer monitors may not have the same color accuracy and resolution needed to depict our products with absolute accuracy. The Company and its affiliates do not warrant that product descriptions, images and Web content are free from errors. We advise requesting a memo or sample before making a purchase decision.

Use of Communications

You agree not to submit, publish or transmit through the Company's Web sites any content that is libelous, obscene, invasive of privacy, illegal, racially or ethnically discriminatory or that would constitute or assist a criminal or civil offense. We reserve the right to pursue any action with respect to information posted on the Van Der Zon Company's Web sites which we believe is appropriate in our sole discretion. We cannot control the information provided by users or content that is made available through our system. By its very nature, other people's information may be offensive, harmful, and inaccurate or may be mislabeled or deceptively labeled.

Acceptance

The following is a statement of Van Der Zon's conditions of sale. Unless buyer advises to the contrary by separate letter accompanying this order, any order issued shall be an acceptance of the conditions of sale as set forth below. Any proposal for additional or different terms or any attempt by buyer to vary in any degree with any of these terms in this order is hereby objected to and rejected. Buyer shall be deemed to assent to these terms and conditions of sale by issuance of an order or by accepting delivery of any products ordered from Van Der Zon, unless Van Der Zon Company is advised to the contrary in writing.

Returns and Claims

No merchandise may be returned without our prior approval and instruction.
No upholstery fabric under 5 yards returned.
No drapery fabric under 9 yards returned.
All authorized returns within 30 days will be subject to freight in/out, plus handling charges.
All authorized returns after 30 days but within 40 days will be subject to a 25% restocking charge, plus in/out freight and handling.
All authorized returns for "damaged" fabric will be inspected.
Van Der Zon reserves the right to assess freight, handling and restocking charges on unsubstantiated claims.
No returns after goods are cut or processed.
No returns after 40 days.

Payment Terms

All orders are subject to the absolute right of "Van Der Zon" Interior Design - LLC. to require of the purchaser payment of all of the

purchase price in advance of delivery.

Van Der Zon accepts: VISA, MASTER CARD

Remedies

In any action for the collection of, or to enforce payment of, all or part of the purchase price

or service to the buyer, Van Der Zon shall be entitled to recover all reasonable collection fees, attorney's

fees and costs, to the extent provided by law.

Shipping

All orders are subject to shipping and/or handling charges.

Prices

This online price list replaces all prior lists and is subject to change without notice.

Force Majeure

Van Der Zon LLC. shall not be liable for delay or failure in performance arising from any cause not within its control.

Finishes

Some collections contain product that is hand painted. Slight variances in color may occur.

Dye Lot Variation

Color will vary from piece to piece. For exact match, you may request Reserve and Cutting for Approval.

Fading

Fabrics not guaranteed against fading/shrinkage through exposure to sun or atmosphere.

Application

Fabric displayed on Van Der Zon Web site represents the intended application direction of the face. Any deviation is at customer's own risk.

Topical Treatments

Caution: Adding topical treatments to any fabric may alter the performance, quality, color or hand. Van Der Zon will not accept responsibility for any fabric treated beyond regular finishes at the mil level. Climatic conditions and humidity in the environment may cause a fabric to contract or expand after installation. We recommend you allow sufficient fabric for these environmental changes. A 2-3% residual shrinkage is reasonable.

Regulatory Compliance

A continuing guarantee under the Textile Fibre Products Identification Act is filed with the Federal Trade Commission.

Disclaimer of Warranties

Unless otherwise expressly indicated in writing, Van Der Zon LLC. makes no warranties, express or implied, including, but not limited to, any representations or warranties with respect to fitness for a particular purpose or merchantability of is fabric and/or product, service. In the event of Van Der Zon's liability, whether based on contract, tort, negligence, strict liability or otherwise, buyer's exclusive remedy will be limited to replacement by Van Der Zon of any defective fabrics/products for which claims is made by the buyer. Van Der Zon expressly disclaims any liability to the buyer, its customers or to the users of its products, for special or consequential damages, including damages to or loss of other property or equipment, personal injury, loss of profits or revenues or cost or other damage, loss or expense from any cause whatsoever, arising out of or in any way connected with the sale or use of its products/fabrics and/or services. Any action must be brought with one year from the date of sale or service. Some states do not allow the exclusion or limitation of consequential damages or the limitation on the time this warranty applies, so these limitations may not apply to you.

Shipping and Returns

Shipping Policy

When ordering, provide the email, phone number, fax number and we will confirm your order within one business day, with a quote that includes the appropriate shipping/handling and the Tax cost.

Note: Expedited orders received after 4:00 PM Pacific standard time,Monday through Friday, will ship via the expedited service selected on the next business day.

All authorized returns within 10 days will be subject to freight in/out, plus handling charges.

All authorized returns after 10 days but within 15 days will be subject to a 25% restocking charge, plus in/out freight and handling.

Van Der Zon LLC. reserves the right to limit or refuse to accept the return of certain merchandise at any time and for any reason.

Van Der Zon LLC. will only accept the return of merchandise purchased from Van Der Zon LLC.

No returns after 15 days.
